In a bid to uphold the integrity of the gambling industry and safeguard consumers, the Dutch Gaming Authority, known as Kansspelautoriteit (KSA), has recently concluded two exhaustive investigations initiated last year. These investigations were spurred by alarming reports of “advertising for illegal gambling offers via affiliate websites and websites of (online) newspapers”, signaling a pressing need for regulatory intervention.
The KSA’s investigations delved deep into the realm of online gambling advertisements, uncovering a concerning trend of enticing consumers to engage with unauthorized gambling operators. Of particular concern was the exploitation of individuals registered in Cruks, the Dutch self-exclusion system. These vulnerable individuals were found to be disproportionately targeted by advertisements luring them to gamble with illegal online gambling providers, thus circumventing the protective measures established by Cruks.
Engaging in gambling activities without Cruks registration poses significant risks, both to individual well-being and societal welfare at large. Cruks serves as a vital safety net, effectively barring registered individuals from accessing legal gambling services. Consequently, any promotion encouraging consumers to sidestep this system not only undermines responsible gambling practices but also exacerbates issues related to problem gambling, potentially leading to severe personal and social consequences.
The KSA underscored the insidious nature of actively targeting Cruks-registered individuals with gambling advertisements. Such exploitative tactics not only run afoul of regulatory standards but also perpetuate harmful behaviors associated with gambling addiction. By specifically tailoring ads to this vulnerable demographic, unscrupulous operators perpetuate the cycle of irresponsible gaming, ultimately compromising consumer welfare and societal well-being.
Following exhaustive investigations, the KSA identified a disturbing prevalence of advertisements promoting illegal gambling operators across various online platforms. As a result, the regulator has initiated enforcement actions against 14 out of the 33 websites examined for their complicity in facilitating illegal gambling activities. Additionally, the discovery of advertisements for seven illicit casinos has prompted the KSA to commence sanctions proceedings against these rogue operators, sending a clear message of zero tolerance towards illegal gambling practices.
